    4  and insert:
    5  does not apply to a person who: caused the discharge or other
    6  condition of pollution at a property subject to a brownfield
    7  site rehabilitation agreement or who is otherwise liable under
    8  applicable successor liability principles; commits fraud in
    9  demonstrating site conditions or completing site rehabilitation
   10  of a property subject to a brownfield site rehabilitation
   11  agreement; or exacerbates contamination of a property subject to
   12  a brownfield site rehabilitation agreement in violation of
   13  applicable laws, which causes property damages.
