Subsection (5) is added to section 403.709, 7 Florida Statutes, to read: 8 403.709 Solid Waste Management Trust Fund; use of waste 9 tire fees.—There is created the Solid Waste Management Trust 10 Fund, to be administered by the department. 11 (5)(a) Notwithstanding subsection (1), a solid waste 12 landfill closure account is established within the Solid Waste 13 Management Trust Fund to provide funding for the closing and 14 long-term care of solid waste management facilities. The 15 department may use funds from the account to contract with a 16 third party for the closing and long-term care of a solid waste 17 management facility if: 18 1. The facility has or had a department permit to operate 19 the facility; 20 2. The permittee provided proof of financial assurance for 21 closure in the form of an insurance certificate; 22 3. The facility is deemed to be abandoned or was ordered to 23 close by the department; 24 4. Closure is accomplished in substantial accordance with a 25 closure plan approved by the department; and 26 5. The department has written documentation that the 27 insurance company issuing the closure insurance policy will 28 provide or reimburse the funds required to complete closing and 29 long-term care of the facility. 30 (b) The department shall deposit the funds received from 31 the insurance company as reimbursement for the costs of closing 32 or long-term care of the facility into the solid waste landfill 33 closure account. 34 35 ================= T I T L E A M E N D M E N T ================ 36 And the title is amended as follows: 37 Delete lines 2 - 15 38 and insert: 39 An act relating to waste; amending s. 376.78, F.S.; 40 revising legislative intent with regard to community 41 revitalization in certain areas; amending s. 376.80, 42 F.S.; revising procedures for designation of 43 brownfield areas by local governments; providing 44 procedures for adoption of a resolution; providing 45 requirements for notice and public hearings; 46 authorizing local governments to use a term other than 47 “brownfield area” when naming such areas; amending s. 48 376.82, F.S.; providing an exemption from liability 49 for property damage for entities that execute and 50 implement certain brownfield site rehabilitation 51 agreements; providing for applicability; amending s. 52 403.709, F.S.; establishing a solid waste landfill 53 closure account within the Solid Waste Management 54 Trust Fund; authorizing the Department of 55 Environmental Protection to use funds to contract with 56 certain parties; requiring the department to deposit 57 certain funds into the solid waste landfill closure 58 account; providing an effective date.
