    2         An act relating to monuments on the Capitol Complex;
    3         creating s. 265.0031, F.S.; providing legislative
    4         intent; defining the term “Capitol Complex”;
    5         establishing the POW-MIA Chair of Honor Memorial;
    6         authorizing the Florida chapters of Rolling Thunder,
    7         Inc., to fund the memorial; requiring the Department
    8         of Management Services to consider recommendations of
    9         the Department of Veterans’ Affairs, the Florida
   10         chapters of Rolling Thunder, Inc., and the Florida
   11         Historical Commission, regarding specific aspects of
   12         the memorial; requiring the Department of Management
   13         Services to coordinate with the Division of Historical
   14         Resources regarding design and placement; creating s.
   15         265.111, F.S.; defining the term “monument”;
   16         prohibiting the construction and placement of a
   17         monument on the premises of the Capitol Complex unless
   18         authorized by general law and approved by the
   19         Department of Management Services; requiring the
   20         Department of Management Services to coordinate with
   21         the Division of Historical Resources regarding design
   22         and placement of a monument; requiring the Department
   23         of Management Services to set aside an area of the
   24         Capitol Complex for a memorial garden; establishing
   25         requirements for the memorial garden; amending s.
   26         267.0612, F.S.; revising the powers and duties of the
   27         Florida Historical Commission to conform to changes
   28         made by the act; providing for applicability;
   29         providing an effective date.
   30          
   31  Be It Enacted by the Legislature of the State of Florida:
   32  
   33         Section 1. Section 265.0031, Florida Statutes, is created
   34  to read:
   35         265.0031 POW-MIA Chair of Honor Memorial.—
   36         (1) It is the intent of the Legislature to recognize and
   37  honor the sacrifices endured by members of the Armed Forces of
   38  the United States who were held as prisoners of war or remain
   39  missing in action.
   40         (2) For purposes of this section, the term “Capitol
   41  Complex” has the same meaning as in s. 281.01.
   42         (3) There is established the POW-MIA Chair of Honor
   43  Memorial.
   44         (a) The POW-MIA Chair of Honor Memorial shall be funded by
   45  the Florida chapters of Rolling Thunder, Inc., without
   46  appropriation of state funds.
   47         (b) Pursuant to s. 255.249(1), the Department of Management
   48  Services shall approve the design and placement of the POW-MIA
   49  Chair of Honor Memorial in the Capitol Complex. The Department
   50  of Management Services must consider recommendations from the
   51  Department of Veterans’ Affairs, the Florida chapters of Rolling
   52  Thunder, Inc., and the Florida Historical Commission in
   53  determining the appropriate design and placement of the
   54  memorial. The Department of Management Services shall coordinate
   55  with the Division of Historical Resources of the Department of
   56  State regarding the memorial’s design and placement subject to
   57  the division’s powers and duties under s. 267.031.
   58         Section 2. Section 265.111, Florida Statutes, is created to
   59  read:
   60         265.111 Capitol Complex; monuments.—
   61         (1) For purposes of this section, the term “monument” means
   62  a permanent structure such as a marker, statue, sculpture,
   63  plaque, or other artifice, including living plant material,
   64  placed in remembrance or recognition of a significant person or
   65  event in Florida history. The term does not include any
   66  “Official Florida Historical Marker” as defined in s. 267.021.
   67         (2) The construction and placement of a monument on the
   68  premises of the Capitol Complex, as defined in s. 281.01, is
   69  prohibited unless authorized by general law and unless the
   70  design and placement of the monument is approved by the
   71  Department of Management Services after considering the
   72  recommendations of the Florida Historical Commission, pursuant
   73  to s. 267.0612(9). The Department of Management Services shall
   74  coordinate with the Division of Historical Resources of the
   75  Department of State regarding a monument’s design and placement
   76  subject to the division’s powers and duties under s. 267.031.
   77         (3) The Department of Management Services, in consultation
   78  with the Florida Historical Commission, shall set aside an area
   79  of the Capitol Complex, not including the State Capital Circle
   80  Office Complex, and dedicate a memorial garden on which
   81  authorized monuments shall be placed.
   82         Section 3. Subsection (9) is added to section 267.0612,
   83  Florida Statutes, to read:
   84         267.0612 Florida Historical Commission; creation;
   85  membership; powers and duties.—In order to enhance public
   86  participation and involvement in the preservation and protection
   87  of the state’s historic and archaeological sites and properties,
   88  there is created within the Department of State the “Florida
   89  Historical Commission.” The commission shall serve in an
   90  advisory capacity to the director of the Division of Historical
   91  Resources to assist the director in carrying out the purposes,
   92  duties, and responsibilities of the division, as specified in
   93  this chapter.
   94         (9) The commission shall provide recommendations to the
   95  Department of Management Services on the design and placement of
   96  monuments authorized by general law to be placed on the premises
   97  of the Capitol Complex pursuant to s. 265.111.
   98         Section 4. The provisions of s. 265.111, Florida Statutes,
   99  as created by this act, do not apply to a monument constructed
  100  and placed on the premises of the Capitol Complex before July 1,
  101  2014.
  102         Section 5. This act shall take effect July 1, 2014.
