Floor: SENA1/C 04/29/2014 03:26 PM . 05/01/2014 03:00 PM ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Brandes moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 1213 - 1268 4 and insert: 5 (d) For any renewal of the applicant’s license, the 6 department shall request the Department of Law Enforcement to 7 forward the retained fingerprints of the applicant to the 8 Federal Bureau of Investigation unless the applicant is enrolled 9 in the national retained print arrest notification program 10 described in paragraph (c). The fee for the national criminal 11 history check shall be paid as part of the renewal process to 12 the department and forwarded by the department to the Department 13 of Law Enforcement. If the applicant’s fingerprints are retained 14 in the national retained print arrest notification program, the 15 applicant shall pay the state and national retention fee to the 16 department, which shall forward the fee to the Department of Law 17 Enforcement. 18 (e) The department shall notify the Department of Law 19 Enforcement regarding any person whose fingerprints have been 20 retained but who is no longer licensed under this chapter. 21 (f) The department shall screen background results to 22 determine whether an applicant meets licensure requirements. 23 (4) A solicitor license must be renewed annually by the 24 submission of a renewal application. A solicitor license that is 25 not renewed expires without further action by the department. 26 (5) Any material change to the information submitted to the 27 department in the initial application or renewal application for 28 a solicitor license shall be reported to the department by the 29 applicant or licensee within 10 days after the change occurs. 30 (6) It is a violation of this chapter: 31 (a) For an applicant to provide inaccurate or incomplete 32 information to the department in the initial or renewal 33 application for a solicitor license. 34 (b) For a person specified in subsection (1) to fail to 35 maintain a solicitor license as required by this section. 36 (c) For a professional solicitor to allow, require, permit, 37 or authorize an employee without an active solicitor license 38 issued under this section to conduct telephonic solicitations. 39 (7) The department shall adopt rules that allow applicants 40 to engage in solicitation activities on a temporary basis until 41 such time as a solicitor license is granted or denied. 42 (8) The department may deny or revoke a solicitor license 43 if the applicant or licensee has had the right to solicit 44 contributions revoked in any state, has been ordered by a court 45 or governmental agency to cease soliciting contributions within 46 any state, or is subject to any disqualification specified in s. 47 496.410(14). 48 (9) Any administrative proceeding that could result in 49 entry of an order under this section shall be conducted in 50 accordance with chapter 120. 51 52 ================= T I T L E A M E N D M E N T ================ 53 And the title is amended as follows: 54 Delete lines 106 - 111 55 and insert: 56 renewed annually; requiring material changes in 57 applications or renewal applications to be reported to 58 the department within a specified period; providing 59 violations; requiring the
