Paragraph (c) of subsection (1) of section 6 125.0103, Florida Statutes, is amended to read: 7 125.0103 Ordinances and rules imposing price controls; 8 findings required; procedures.— 9 (1) 10 (c) Counties shallmustestablish maximum rates thatwhich11 may be charged foronthe towing of vehicles fromor12immobilization of vehicles onprivate property, the 13 immobilization of vehicles on public and private property, the 14 removal and storage of wrecked or disabled vehicles from an 15 accident scene or for the removal and storage of vehicles, in 16 the event the owner or operator is incapacitated, unavailable, 17 leaves the procurement of wrecker service to the law enforcement 18 officer at the scene, or otherwise does not consent to the 19 removal of the vehicle. Notwithstanding any other provision of 20 law, the maximum rate or fee that may be charged for the 21 immobilization of vehicles on public and private property is 22 $25. However, if a municipality chooses to enact an ordinance 23 establishing the maximum fees for the towingor immobilization24 of vehicles as described in paragraph (b), the county’s 25 ordinance doesshallnot apply within such municipality. 26 Section 2.
