The Committee on Appropriations (Bean) recommended the following
amendment:
Section: 03 EXPLANATION:
On Page: 055 Establishes standards for burial insurance to assure
consumers can prepare for their final burial
Spec App: 236 expenses without adversely affecting Medicaid
eligibility. This amendment also allows a person to
hold a burial policy that is not assigned to a trust
or tied to a particular funeral home and can move
with them as their life circumstances change.

Immediately preceding Specific Appropriation 236, INSERT:
From funds in Specific Appropriations 236 through 245 the Agency for
Health Care Administration, in consultation with the Department of
Children and Families, shall prepare a Medicaid State Plan amendment to
exempt the value of life insurance policies, annuities or group
certificates used exclusively for burial expenses of the owner in
determining eligibility for Medical Assistance as defined by section
409.901(21), Florida Statutes. The state plan amendment shall conform to
limits established in section 626.785(3), Florida Statutes, and with any
other applicable requirements of state and Federal law. Prior to
submission of the Medicaid State Plan amendment for approval, the Social
Services Estimating Conference shall prepare an estimate of any
projected fiscal impact and the agency shall submit the state plan
amendment along with the estimate to the Legislative Budget Commission
