       Senator Garcia moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 401 and 402
    4  insert:
    5         Section 5. Paragraph (f) of subsection (5) of section
    6  400.235, Florida Statutes, is amended to read:
    7         400.235 Nursing home quality and licensure status; Gold
    8  Seal Program.—
    9         (5) Facilities must meet the following additional criteria
   10  for recognition as a Gold Seal Program facility:
   11         (f) Evidence that verified an outstanding record regarding
   12  the number and types of substantiated complaints reported to the
   13  Office of State Long-Term Care Ombudsman Council within the 30
   14  months preceding application for the program have been resolved
   15  or, if not resolved, the facility has made a good faith effort
   16  to resolve the complaints.

   18  A facility assigned a conditional licensure status may not
   19  qualify for consideration for the Gold Seal Program until after
   20  it has operated for 30 months with no class I or class II
   21  deficiencies and has completed a regularly scheduled relicensure
   22  survey.
