Florida Senate - 2014 SJR 756 By Senator Ring 29-01064-14 2014756__ 1 Senate Joint Resolution 2 A joint resolution proposing an amendment to Section 2 3 of Article IV of the State Constitution to require the 4 Governor to assign the Lieutenant Governor the duty of 5 serving as the head of any one department or agency of 6 the executive branch. 7 8 Be It Resolved by the Legislature of the State of Florida: 9 10 That the following amendment to Section 2 of Article IV of 11 the State Constitution is agreed to and shall be submitted to 12 the electors of this state for approval or rejection at the next 13 general election or at an earlier special election specifically 14 authorized by law for that purpose: 15 ARTICLE IV 16 EXECUTIVE 17 SECTION 2. Lieutenant governor.— 18 (a) There shall be a lieutenant governor, who shall perform 19 such duties pertaining to the office of governor as shall be 20 assigned by the governor, except when otherwise provided by law, 21 and such other duties as may be prescribed by law. 22 (b) The governor shall assign the lieutenant governor the 23 duty of serving as the head of any one department or agency of 24 the executive branch, the head of which is appointed by the 25 governor, notwithstanding any qualifications prescribed by law 26 for appointment of the head of that department or agency. Such 27 assignment or action to rescind the assignment is not subject to 28 confirmation by the senate or approval by any member of the 29 cabinet. 30 BE IT FURTHER RESOLVED that the following statement be 31 placed on the ballot: 32 CONSTITUTIONAL AMENDMENT 33 ARTICLE IV, SECTION 2 34 DUTIES OF LIEUTENANT GOVERNOR.—Proposing an amendment to 35 the State Constitution that requires the Governor to assign the 36 Lieutenant Governor the duty of serving as the head of any one 37 executive department or agency. The assignment or action to 38 rescind the assignment is not subject to confirmation by the 39 Senate or approval by any member of the Cabinet.
