2 An act relating to a review under the Open Government
3 Sunset Review Act; amending s. 288.985, F.S., which
4 provides exemptions from public records and public
5 meetings requirements for certain records and meetings
6 of the Florida Defense Support Task Force; removing
7 the penalty; removing superfluous language; saving the
8 exemptions from repeal under the Open Government
9 Sunset Review Act; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 288.985, Florida Statutes, is amended to
14 read:
15 288.985 Exemptions from public records and public meetings
16 requirements.—
17 (1) The following records held by the Florida Defense
18 Support Task Force are exempt from s. 119.07(1) and s. 24(a),
19 Art. I of the State Constitution:
20 (a) That portion of a record which relates to strengths and
21 weaknesses of military installations or military missions in
22 this state relative to the selection criteria for the
23 realignment and closure of military bases and missions under any
24 United States Department of Defense base realignment and closure
25 process.
26 (b) That portion of a record which relates to strengths and
27 weaknesses of military installations or military missions in
28 other states or territories and the vulnerability of such
29 installations or missions to base realignment or closure under
30 the United States Department of Defense base realignment and
31 closure process, and any agreements or proposals to relocate or
32 realign military units and missions from other states or
33 territories.
34 (c) That portion of a record which relates to the state’s
35 strategy to retain its military bases during any United States
36 Department of Defense base realignment and closure process and
37 any agreements or proposals to relocate or realign military
38 units and missions.
39 (2)(a) Meetings or portions of meetings of the Florida
40 Defense Support Task Force, or a workgroup of the task force, at
41 which records are presented or discussed that which are exempt
42 under subsection (1) are exempt from s. 286.011 and s. 24(b),
43 Art. I of the State Constitution.
44 (b)(3) Any records generated during those portions of
45 meetings that which are exempt closed to the public under
46 paragraph (a) subsection (2), including, but not limited to,
47 minutes, tape recordings, videotapes, digital recordings,
48 transcriptions, or notes, are exempt from s. 119.07(1) and s.
49 24(a), Art. I of the State Constitution.
50 (4) Any person who willfully and knowingly violates this
51 section commits a misdemeanor of the first degree, punishable as
52 provided in s. 775.082 or s. 775.083.
53 (5) This section is subject to the Open Government Sunset
54 Review Act in accordance with s. 119.15 and shall stand repealed
55 on October 2, 2014, unless reviewed and saved from repeal
56 through reenactment by the Legislature.
57 Section 2. This act shall take effect October 1, 2014.
