The Committee on Transportation (Evers) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 23 - 39
4 and insert:
5 (f) A melon hauling vehicle: $7.50 flat. The term “melon
6 hauling vehicle” means a vehicle that has been altered from its
7 original use so that the primary purpose is to transport melons
8 from a farm or harvest place to the first place of processing or
9 storage, or from a farm or harvest place directly to market.
10 Section 2. Paragraph (c) of subsection (2) of section
11 322.53, Florida Statutes, is amended to read:
12 322.53 License required; exemptions.—
13 (2) The following persons are exempt from the requirement
14 to obtain a commercial driver license:
15 (c)1. Farmers transporting agricultural products, farm
16 supplies, or farm machinery to or from their farms and within
17 150 miles of their farms, if the vehicle operated under this
18 exemption is not used in the operations of a common or contract
19 motor carrier.
20 2. Drivers of melon hauling vehicles registered under s.
21 320.08(3)(f). However, such drivers must comply with 49 C.F.R.
22 parts 382, 392, and 393 and 49 C.F.R. ss. 396.3(a)(1) and 396.9.
