Florida Senate - 2015 SB 1254 By Senator Bean 4-01276B-15 20151254__ 1 A bill to be entitled 2 An act relating to noncriminal traffic infractions; 3 creating s. 316.0275, F.S.; providing criminal 4 penalties for certain noncriminal traffic infractions 5 that cause serious bodily injury or death to a person; 6 providing an effective date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1. Section 316.0275, Florida Statutes, is created 11 to read: 12 316.0275 Noncriminal traffic infractions leading to serious 13 bodily injury or death; reclassification.— 14 (1) Notwithstanding any other provision of law, if an 15 individual commits a noncriminal traffic infraction under this 16 chapter which causes serious bodily injury or death to a person 17 and within 5 years after that violation, commits another 18 noncriminal traffic infraction under this chapter which causes 19 serious bodily injury or death to a person, the second such 20 violation shall be reclassified as a felony of the third degree, 21 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 22 (2) As used in this section, the term “serious bodily 23 injury” means an injury to a person, excluding the at-fault 24 driver, which consists of a physical condition that creates a 25 substantial risk of death, serious personal disfigurement, or 26 protracted loss or impairment of the function of any bodily 27 member or organ. 28 Section 2. This act shall take effect July 1, 2015.
