    1                        A bill to be entitled                      
    2         An act relating to the protection of licensed health
    3         care workers; creating s. 448.115, F.S.; defining
    4         terms; prohibiting an employer from taking
    5         disciplinary action against a licensed health care
    6         worker in the employment of the employer under certain
    7         circumstances; providing an effective date.
    8          
    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 448.115, Florida Statutes, is created to
   12  read:
   13         448.115 Protection of licensed health care workers.—
   14         (1) As used in this section, the term:
   15         (a) “Employer” means a hospital, medical or health care
   16  facility, individual, firm, partnership, institution,
   17  governmental entity, corporation, or association that employs a
   18  licensed health care worker.
   19         (b) “Licensed health care worker” means an individual
   20  licensed under chapter 464 or chapter 468.
   21         (2) An employer may not discipline, threaten with
   22  discipline, or take retaliatory personnel action against a
   23  licensed health care worker in the employment of the employer
   24  because the licensed health care worker refuses to take an
   25  assignment that is outside of his or her competency or that
   26  would give rise to grounds for discipline against the licensed
   27  health care worker under s. 456.072(1)(o), s. 464.018(1)(n), or
   28  s. 468.365(1)(m) or (1)(n).
   29         Section 2. This act shall take effect July 1, 2015.
