House Comm: WD . 03/30/2015 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Criminal Justice (Bradley) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 211 - 288 4 and insert: 5 (III) Residential addresses, including former residences 6 and residences in which the person frequently resides other than 7 the person’s home address, e-mail addresses, driver license 8 numbers, license plate numbers, and banking and financial 9 information of current or former public defenders, assistant 10 public defenders, criminal conflict and civil regional counsel, 11 and assistant criminal conflict and civil regional counsel, and 12 the home addresses, telephone numbers, social security numbers, 13 photographs, dates of birth, and places of employment of the 14 parents, siblings, and cohabitants of current or former public 15 defenders, assistant public defenders, criminal conflict and 16 civil regional counsel, and assistant criminal conflict and 17 civil regional counsel are exempt from s. 24(a), Art. I of the 18 State Constitution. This sub-sub-subparagraph is subject to the 19 Open Government Sunset Review Act in accordance with s. 119.15 20 and shall stand repealed on October 2, 2020, unless reviewed and 21 saved from repeal through reenactment by the Legislature. 22 k. The home addresses, telephone numbers, and photographs 23 of current or former investigators or inspectors of the 24 Department of Business and Professional Regulation; the names, 25 home addresses, telephone numbers, and places of employment of 26 the spouses and children of such current or former investigators 27 and inspectors; and the names and locations of schools and day 28 care facilities attended by the children of such current or 29 former investigators and inspectors are exempt from s. 119.07(1) 30 and s. 24(a), Art. I of the State Constitution if the 31 investigator or inspector has made reasonable efforts to protect 32 such information from being accessible through other means 33 available to the public. This sub-subparagraph is subject to the 34 Open Government Sunset Review Act in accordance with s. 119.15 35 and shall stand repealed on October 2, 2017, unless reviewed and 36 saved from repeal through reenactment by the Legislature. 37 l. The home addresses and telephone numbers of county tax 38 collectors; the names, home addresses, telephone numbers, and 39 places of employment of the spouses and children of such tax 40 collectors; and the names and locations of schools and day care 41 facilities attended by the children of such tax collectors are 42 exempt from s. 119.07(1) and s. 24(a), Art. I of the State 43 Constitution if the county tax collector has made reasonable 44 efforts to protect such information from being accessible 45 through other means available to the public. This sub 46 subparagraph is subject to the Open Government Sunset Review Act 47 in accordance with s. 119.15 and shall stand repealed on October 48 2, 2017, unless reviewed and saved from repeal through 49 reenactment by the Legislature. 50 m. The home addresses, telephone numbers, dates of birth, 51 and photographs of current or former personnel of the Department 52 of Health whose duties include, or result in, the determination 53 or adjudication of eligibility for social security disability 54 benefits, the investigation or prosecution of complaints filed 55 against health care practitioners, or the inspection of health 56 care practitioners or health care facilities licensed by the 57 Department of Health; the names, home addresses, telephone 58 numbers, dates of birth, and places of employment of the spouses 59 and children of such personnel; and the names and locations of 60 schools and day care facilities attended by the children of such 61 personnel are exempt from s. 119.07(1) and s. 24(a), Art. I of 62 the State Constitution if the personnel have made reasonable 63 efforts to protect such information from being accessible 64 through other means available to the public. This sub 65 subparagraph is subject to the Open Government Sunset Review Act 66 in accordance with s. 119.15 and shall stand repealed on October 67 2, 2019, unless reviewed and saved from repeal through 68 reenactment by the Legislature. 69 3. An agency that is the custodian of the information 70 specified in subparagraph 2. and that is not the employer of the 71 officer, employee, justice, judge, or other person specified in 72 subparagraph 2. shall maintain the exempt status of that 73 information only if the officer, employee, justice, judge, other 74 person, or employing agency of the designated employee submits a 75 written request for maintenance of the exemption to the 76 custodial agency. 77 4. The exemptions in this paragraph apply to information 78 held by an agency before, on, or after the effective date of the 79 exemption. 80 5. Except as otherwise expressly provided in this 81 paragraph, this paragraph is subject to the Open Government 82 Sunset Review Act in accordance with s. 119.15, and shall stand 83 repealed on October 2, 2017, unless reviewed and saved from 84 repeal through reenactment by the Legislature. 85 Section 2. The Legislature finds that it is a public 86 necessity that the residential addresses, e-mail addresses, 87 driver license numbers, license plate numbers, and banking and 88 financial information of active or former sworn or civilian law 89 enforcement personnel, including correctional and correctional 90 probation officers, personnel of the Department of Children and 91 Families whose duties include the investigation of abuse, 92 neglect, exploitation, fraud, theft, or other criminal 93 activities, personnel of the Department of Health whose duties 94 are to support the investigation of child abuse or neglect, 95 personnel of the Department of Revenue or local governments 96 whose responsibilities include revenue collection and 97 enforcement or child support enforcement, current or former 98 state attorneys, assistant state attorneys, statewide 99 prosecutors, assistant statewide prosecutors, and current or 100 former public defenders, assistant public defenders, criminal 101 conflict and civil regional counsel, and assistant criminal 102 conflict and civil regional counsel be made exempt 103 104 ================= T I T L E A M E N D M E N T ================ 105 And the title is amended as follows: 106 Delete lines 8 - 9 107 and insert: 108 statewide prosecutors, assistant statewide 109 prosecutors, public defenders, assistant public 110 defenders, criminal conflict and civil regional 111 counsel, and assistant criminal conflict and civil 112 regional counsel, and their parents, siblings, or
