House Comm: RCS . 03/30/2015 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Criminal Justice (Bradley) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 211 - 288 4 and insert: 5 (III) Residential addresses, including former residences 6 and residences in which the person frequently resides other than 7 the person’s home address, e-mail addresses, driver license 8 numbers, license plate numbers, and banking and financial 9 information of current or former public defenders, assistant 10 public defenders, criminal conflict and civil regional counsel, 11 assistant criminal conflict and civil regional counsel, capital 12 collateral regional counsels, and assistant capital collateral 13 regional counsel, and the home addresses, telephone numbers, 14 social security numbers, photographs, dates of birth, and places 15 of employment of the parents, siblings, and cohabitants of 16 current or former public defenders, assistant public defenders, 17 criminal conflict and civil regional counsel, assistant criminal 18 conflict and civil regional counsel, capital collateral regional 19 counsels, and assistant capital collateral regional counsel are 20 exempt from s. 24(a), Art. I of the State Constitution. This 21 sub-sub-subparagraph is subject to the Open Government Sunset 22 Review Act in accordance with s. 119.15 and shall stand repealed 23 on October 2, 2020, unless reviewed and saved from repeal 24 through reenactment by the Legislature. 25 k. The home addresses, telephone numbers, and photographs 26 of current or former investigators or inspectors of the 27 Department of Business and Professional Regulation; the names, 28 home addresses, telephone numbers, and places of employment of 29 the spouses and children of such current or former investigators 30 and inspectors; and the names and locations of schools and day 31 care facilities attended by the children of such current or 32 former investigators and inspectors are exempt from s. 119.07(1) 33 and s. 24(a), Art. I of the State Constitution if the 34 investigator or inspector has made reasonable efforts to protect 35 such information from being accessible through other means 36 available to the public. This sub-subparagraph is subject to the 37 Open Government Sunset Review Act in accordance with s. 119.15 38 and shall stand repealed on October 2, 2017, unless reviewed and 39 saved from repeal through reenactment by the Legislature. 40 l. The home addresses and telephone numbers of county tax 41 collectors; the names, home addresses, telephone numbers, and 42 places of employment of the spouses and children of such tax 43 collectors; and the names and locations of schools and day care 44 facilities attended by the children of such tax collectors are 45 exempt from s. 119.07(1) and s. 24(a), Art. I of the State 46 Constitution if the county tax collector has made reasonable 47 efforts to protect such information from being accessible 48 through other means available to the public. This sub 49 subparagraph is subject to the Open Government Sunset Review Act 50 in accordance with s. 119.15 and shall stand repealed on October 51 2, 2017, unless reviewed and saved from repeal through 52 reenactment by the Legislature. 53 m. The home addresses, telephone numbers, dates of birth, 54 and photographs of current or former personnel of the Department 55 of Health whose duties include, or result in, the determination 56 or adjudication of eligibility for social security disability 57 benefits, the investigation or prosecution of complaints filed 58 against health care practitioners, or the inspection of health 59 care practitioners or health care facilities licensed by the 60 Department of Health; the names, home addresses, telephone 61 numbers, dates of birth, and places of employment of the spouses 62 and children of such personnel; and the names and locations of 63 schools and day care facilities attended by the children of such 64 personnel are exempt from s. 119.07(1) and s. 24(a), Art. I of 65 the State Constitution if the personnel have made reasonable 66 efforts to protect such information from being accessible 67 through other means available to the public. This sub 68 subparagraph is subject to the Open Government Sunset Review Act 69 in accordance with s. 119.15 and shall stand repealed on October 70 2, 2019, unless reviewed and saved from repeal through 71 reenactment by the Legislature. 72 3. An agency that is the custodian of the information 73 specified in subparagraph 2. and that is not the employer of the 74 officer, employee, justice, judge, or other person specified in 75 subparagraph 2. shall maintain the exempt status of that 76 information only if the officer, employee, justice, judge, other 77 person, or employing agency of the designated employee submits a 78 written request for maintenance of the exemption to the 79 custodial agency. 80 4. The exemptions in this paragraph apply to information 81 held by an agency before, on, or after the effective date of the 82 exemption. 83 5. Except as otherwise expressly provided in this 84 paragraph, this paragraph is subject to the Open Government 85 Sunset Review Act in accordance with s. 119.15, and shall stand 86 repealed on October 2, 2017, unless reviewed and saved from 87 repeal through reenactment by the Legislature. 88 Section 2. The Legislature finds that it is a public 89 necessity that the residential addresses, e-mail addresses, 90 driver license numbers, license plate numbers, and banking and 91 financial information of active or former sworn or civilian law 92 enforcement personnel, including correctional and correctional 93 probation officers, personnel of the Department of Children and 94 Families whose duties include the investigation of abuse, 95 neglect, exploitation, fraud, theft, or other criminal 96 activities, personnel of the Department of Health whose duties 97 are to support the investigation of child abuse or neglect, 98 personnel of the Department of Revenue or local governments 99 whose responsibilities include revenue collection and 100 enforcement or child support enforcement, current or former 101 state attorneys, assistant state attorneys, statewide 102 prosecutors, assistant statewide prosecutors, public defenders, 103 assistant public defenders, criminal conflict and civil regional 104 counsel, assistant criminal conflict and civil regional counsel, 105 capital collateral regional counsels, and assistant capital 106 collateral regional counsel be made exempt 107 108 ================= T I T L E A M E N D M E N T ================ 109 And the title is amended as follows: 110 Delete lines 8 - 9 111 and insert: 112 statewide prosecutors, assistant statewide 113 prosecutors, public defenders, assistant public 114 defenders, criminal conflict and civil regional 115 counsel, assistant criminal conflict and civil 116 regional counsel, capital collateral regional 117 counsels, and assistant capital collateral regional 118 counsel and their parents, siblings, or
