Florida Senate - 2015 SB 1406 By Senator Bullard 39-01388-15 20151406__ 1 A bill to be entitled 2 An act relating to education; creating s. 1003.07, 3 F.S.; prohibiting the Department of Education or a 4 district school board from entering into certain 5 agreements that cede or limit state or district 6 autonomy over academic content standards and 7 corresponding assessments; requiring the department or 8 district school board to amend or terminate certain 9 agreements, memoranda, and contracts; suspending the 10 statewide assessment program, the school grading 11 system, and the personnel evaluation system for a 12 specified period; providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Section 1003.07, Florida Statutes, is created to 17 read: 18 1003.07 State and school district sovereignty.— 19 (1) Notwithstanding any other provision of law, the 20 Department of Education or a district school board may not enter 21 into any agreement, memorandum of understanding, or contract 22 with a federal agency or private entity that cedes or limits the 23 state’s or school district’s control over the development, 24 adoption, or revision of the state’s academic content standards 25 or corresponding assessments, including, but not limited to, 26 agreements, memoranda, or contracts for funding public schools 27 and programs. 28 (2) If the department or a district school board entered 29 into an agreement, memorandum, or contract before the effective 30 date of this section, and such agreement, memorandum, or 31 contract would be prohibited under subsection (1) if entered 32 into on or after July 1, 2015, the department or district school 33 board must amend or terminate the agreement, memorandum, or 34 contract to comply with the requirements of subsection (1). 35 (3) Effective July 1, 2015, the following are suspended 36 until new academic content standards are adopted and 37 corresponding assessments are developed: 38 (a) The statewide assessment program under s. 1008.22. 39 (b) The school grading system under s. 1008.34. 40 (c) The personnel evaluation system under s. 1012.34. 41 Section 2. This act shall take effect July 1, 2015.
