The Committee on Appropriations (Richter) recommended the
following:
1 Senate Amendment (with title amendment)

3 Between lines 934 and 935
4 insert:
5 Section 22. Subsection (4) is added to section 790.15,
6 Florida Statutes, to read:
7 790.15 Discharging firearm in public or on residential
8 property.—
9 (4) Any person who recreationally discharges a firearm
10 outdoors, including for target shooting or celebratory shooting,
11 in an area that the person knows or reasonably should know is
12 primarily residential in nature and that has a residential
13 density of one or more dwelling units per acre, commits a
14 misdemeanor of the first degree, punishable as provided in s.
15 775.082 or s. 775.083. This subsection does not apply:
16 (a) To a person lawfully defending life or property or
17 performing official duties requiring the discharge of a firearm;
18 or
19 (b) If, under the circumstances, the discharge does not
20 pose a reasonably foreseeable risk to life, safety, or property.

23 And the title is amended as follows:
24 Delete line 110
25 and insert:
26 licenses; amending s. 790.15, F.S.; prohibiting the
27 recreational discharge of a firearm in certain
28 residential areas; providing criminal penalties;
29 providing exceptions; providing an effective date.
