House . . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Latvala moved the following: 1 Senate Amendment 2 3 Delete line 67 4 and insert: 5 (d) Confidential and exempt proprietary business 6 information must be disclosed to any health professional who 7 requests such information in writing if the health professional 8 provides a written statement of need for the information and 9 agrees in writing to maintain the confidential and exempt status 10 of the information. The written statement of need shall be a 11 statement that the health professional has a reasonable basis to 12 believe that: 13 1. The information is needed for purposes of diagnosis or 14 treatment of an individual; 15 2. The individual being diagnosed or treated may have been 16 exposed to a chemical considered confidential and exempt 17 proprietary business information; and 18 3. Knowledge of a chemical considered confidential and 19 exempt proprietary business information will assist in such 20 diagnosis or treatment. 21 (e) Confidential and exempt proprietary business 22 information must be immediately disclosed to any health 23 professional if the health professional determines a medical 24 emergency exists and the confidential and exempt proprietary 25 business information is necessary for emergency treatment. The 26 health professional must verbally acknowledge that such 27 information shall be kept confidential and not be used for 28 purposes other than the health needs asserted. 29 (f) Confidential and exempt proprietary business 30 information must be immediately disclosed to any first responder 31 as defined in s. 112.1815(1) if the first responder determines 32 an emergency exists and the confidential and exempt proprietary 33 business information is necessary to assess and respond to the 34 emergency. The first responder must verbally acknowledge that 35 such information shall be kept confidential and not be used for 36 purposes other than to assess and respond to the emergency. 37 (g) Information disclosed to a health professional or 38 emergency responder shall not become part of the chemical 39 disclosure registry and shall in no way be construed as publicly 40 available. 41 (h) This subsection is subject to the Open Government
