Florida Senate - 2015 SB 324 By Senator Diaz de la Portilla 40-00518-15 2015324__ 1 A bill to be entitled 2 An act relating to specialty license plates; amending 3 ss. 320.08056 and 320.08058, F.S.; requiring the 4 Department of Highway Safety and Motor Vehicles to 5 create a Take Stock in Children license plate; 6 establishing an annual use fee for the plate; 7 providing for the distribution of use fee revenues 8 received from the sale of such plates; providing an 9 effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (iiii) is added to subsection (4) of 14 section 320.08056, Florida Statutes, to read: 15 320.08056 Specialty license plates.— 16 (4) The following license plate annual use fees shall be 17 collected for the appropriate specialty license plates: 18 (iiii) Take Stock in Children license plate, $25. 19 Section 2. Subsection (87) is added to section 320.08058, 20 Florida Statutes, to read: 21 320.08058 Specialty license plates.— 22 (87) TAKE STOCK IN CHILDREN LICENSE PLATES.— 23 (a) Notwithstanding s. 45, chapter 2008-176, Laws of 24 Florida, as amended by s. 45, chapter 2014-216, Laws of Florida, 25 and s. 320.08053(1), the department shall develop a Take Stock 26 in Children license plate as provided in s. 320.08053(2) and (3) 27 and this section. The plate must bear the colors and design 28 approved by the department. The word “Florida” must appear at 29 the top of the plate, and the words “Take Stock in Children” 30 must appear at the bottom of the plate. 31 (b) The annual use fees shall be distributed to the Take 32 Stock in Children, Inc., principal office in this state to fund 33 its activities, scholarship and mentoring programs, and 34 projects. Take Stock in Children, Inc., shall retain all revenue 35 from the annual use fees until all startup costs for developing 36 and establishing the plate have been recovered. Thereafter, up 37 to 15 percent of the annual use fee revenue may be used for 38 promotion and marketing of the specialty license plate and cause 39 and up to 10 percent of the annual use fee revenue may be used 40 for administrative costs directly associated with the 41 corporation’s programs and the specialty license plate. 42 Section 3. This act shall take effect July 1, 2015.
