The Committee on Appropriations (Gaetz) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. (1) The following trust funds within the
6 Department of Education or Board of Governors of the State
7 University System are terminated:
8 (a) The Building Fee Trust Fund, FLAIR numbers 48-2-064 and
9 4890-2-064. All current balances remaining in, and all revenues
10 of, the Building Fee Trust Fund terminated by this act shall be
11 transferred to the Capital Improvement Fee Trust Fund.
12 (b) The Replacement Trust Fund, FLAIR numbers 48-2-580 and
13 4890-2-580. All current balances remaining in, and all revenues
14 of, the Replacement Trust fund terminated by this act shall be
15 transferred to each university’s local account.
16 (c) The State University System Concurrency Trust Fund,
17 FLAIR numbers 48-2-682 and 4890-2-682.
18 (d) The State University Law Enforcement Trust Fund, FLAIR
19 numbers 48-2-434 and 4890-2-434.
20 (e) The Uniform Payroll Trust Fund, FLAIR numbers 48-2-766
21 and 4890-2-766.
22 (2) Unless otherwise provided, all current balances
23 remaining in, and all revenues of, the trust funds terminated by
24 this act shall be transferred to the General Revenue Fund.
25 (3) For each trust fund terminated by this section, the
26 Department of Education or Board of Governors of the State
27 University System shall pay any outstanding debts and
28 obligations of the terminated funds as soon as practicable, and
29 the Chief Financial Officer shall close out and remove the
30 terminated funds from various state accounting systems using
31 generally accepted accounting principles concerning warrants
32 outstanding, assets, and liabilities.
33 Section 2. Paragraph (g) of subsection (6) of section
34 932.7055, Florida Statutes, is amended to read:
35 932.7055 Disposition of liens and forfeited property.—
36 (6) If the seizing agency is a state agency, all remaining
37 proceeds shall be deposited into the General Revenue Fund.
38 However, if the seizing agency is:
39 (g) One of the State University System police departments
40 acting within the jurisdiction of its employing state
41 university, the proceeds accrued pursuant to the provisions of
42 the Florida Contraband Forfeiture Act shall be deposited into
43 that state university’s appropriate local account special law
44 enforcement trust fund.
45 Section 3. Section 1010.86, Florida Statutes, is amended to
46 read:
47 1010.86 Administration of the capital improvement fee and
48 building fees trust fund funds.—The Board of Governors of the
49 State University System State Board of Education shall
50 administer the Capital Improvement Fee Trust Fund, and the
51 Building Fee Trust Fund which includes include receipts from
52 capital improvement and building student fee assessments,
53 interest earnings, and subsidy grants. All funds, except those
54 to be used for debt service payments, reserve requirements, and
55 educational research centers for child development, pursuant to
56 s. 1011.48, shall be used to fund projects appropriated by the
57 Legislature. Projects funded pursuant to this section may be
58 expanded by the use of supplemental funds such as grants,
59 auxiliary enterprises, private donations, and other nonstate
60 sources.
61 Section 4. This act shall take effect July 1, 2015.

77 and revenues of such trust funds; amending s.
78 932.7055, F.S.; requiring certain proceeds to be
79 deposited into a state university’s appropriate local
80 account instead of the special law enforcement trust
81 fund; amending s 1010.86, F.S; conforming provisions
82 to changes made by this act; providing an effective
83 date.
