2 An act relating to trust funds of the Department of
3 Education and the Board of Governors of the State
4 University System; terminating the Building Fee Trust
5 Fund, the Replacement Trust Fund, the State University
6 System Concurrency Trust Fund, the State University
7 System Law Enforcement Trust Fund, and the Uniform
8 Payroll Trust Fund within the Department of Education
9 and the Board of Governors of the State University
10 System; providing for the disposition of balances in
11 and revenues of such trust funds; amending s.
12 932.7055, F.S.; requiring certain proceeds to be
13 deposited into a state university’s appropriate local
14 account instead of the special law enforcement trust
15 fund; amending s. 1010.86, F.S.; conforming provisions
16 to changes made by this act; providing an effective
17 date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. (1) The following trust funds within the
22 Department of Education or Board of Governors of the State
23 University System are terminated:
24 (a) The Building Fee Trust Fund, FLAIR numbers 48-2-064 and
25 4890-2-064. All current balances remaining in, and all revenues
26 of, the Building Fee Trust Fund terminated by this act shall be
27 transferred to the Capital Improvement Fee Trust Fund.
28 (b) The Replacement Trust Fund, FLAIR numbers 48-2-580 and
29 4890-2-580. All current balances remaining in, and all revenues
30 of, the Replacement Trust fund terminated by this act shall be
31 transferred to each university’s local account.
32 (c) The State University System Concurrency Trust Fund,
33 FLAIR numbers 48-2-682 and 4890-2-682.
34 (d) The State University Law Enforcement Trust Fund, FLAIR
35 numbers 48-2-434 and 4890-2-434.
36 (e) The Uniform Payroll Trust Fund, FLAIR numbers 48-2-766
37 and 4890-2-766.
38 (2) Unless otherwise provided, all current balances
39 remaining in, and all revenues of, the trust funds terminated by
40 this act shall be transferred to the General Revenue Fund.
41 (3) For each trust fund terminated by this section, the
42 Department of Education or Board of Governors of the State
43 University System shall pay any outstanding debts and
44 obligations of the terminated funds as soon as practicable, and
45 the Chief Financial Officer shall close out and remove the
46 terminated funds from various state accounting systems using
47 generally accepted accounting principles concerning warrants
48 outstanding, assets, and liabilities.
49 Section 2. Paragraph (g) of subsection (6) of section
50 932.7055, Florida Statutes, is amended to read:
51 932.7055 Disposition of liens and forfeited property.—
52 (6) If the seizing agency is a state agency, all remaining
53 proceeds shall be deposited into the General Revenue Fund.
54 However, if the seizing agency is:
55 (g) One of the State University System police departments
56 acting within the jurisdiction of its employing state
57 university, the proceeds accrued pursuant to the provisions of
58 the Florida Contraband Forfeiture Act shall be deposited into
59 that state university’s appropriate local account special law
60 enforcement trust fund.
61 Section 3. Section 1010.86, Florida Statutes, is amended to
62 read:
63 1010.86 Administration of the capital improvement fee and
64 building fees trust fund funds.—The Board of Governors of the
65 State University System State Board of Education shall
66 administer the Capital Improvement Fee Trust Fund, and the
67 Building Fee Trust Fund which includes include receipts from
68 capital improvement and building student fee assessments,
69 interest earnings, and subsidy grants. All funds, except those
70 to be used for debt service payments, reserve requirements, and
71 educational research centers for child development, pursuant to
72 s. 1011.48, shall be used to fund projects appropriated by the
73 Legislature. Projects funded pursuant to this section may be
74 expanded by the use of supplemental funds such as grants,
75 auxiliary enterprises, private donations, and other nonstate
76 sources.
77 Section 4. This act shall take effect July 1, 2015.
