Florida Senate - 2015 SB 494 By Senator Thompson 12-00482-15 2015494__ 1 A bill to be entitled 2 An act relating to intimate apparel; creating s. 3 501.935, F.S.; prohibiting retail stores from allowing 4 a customer to try on intimate apparel in the store 5 unless it is tried on over clothing or with a 6 disposable shield; prohibiting a retail store from 7 selling intimate apparel that has been tried on in 8 violation of the prohibition; defining the term 9 “intimate apparel” to include lower undergarments and 10 swimsuit bottoms; providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Section 501.935, Florida Statutes, is created to 15 read: 16 501.935 Intimate apparel.—A retail store may not allow a 17 customer to try on intimate apparel in the store unless the item 18 is tried on over clothing or a disposable shield is used. If a 19 customer tries on an item of intimate apparel in violation of 20 this section, the item is considered defective, and the retail 21 store may not sell the item. As used in this section, the term 22 “intimate apparel” includes lower undergarments, including 23 lingerie, and swimsuit bottoms. 24 Section 2. This act shall take effect July 1, 2015.
