       The Committee on Criminal Justice (Evers) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 58 - 63
    4  and insert:
    5  who violates this section commits a 2nd degree misdemeanor,
    6  punishable as provided in s. 775.082 or s. 775.083.
    7         (b) An individual who is 18 years of age or older at the
    8  time he or she violates this section commits a 1st degree
    9  misdemeanor, punishable as provided in s. 775.082 or s. 775.083,
   10  if the violation involves a sexually explicit
