    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 944.73,
    3         F.S.; creating the State-Operated Institutions Inmate
    4         Welfare Trust Fund within the Department of
    5         Corrections; providing a purpose; requiring that any
    6         balance remaining in the trust fund at the end of the
    7         fiscal year remain in the trust fund; providing an
    8         effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 944.73, Florida Statutes, is created to
   13  read:
   14         944.73 State-Operated Institutions Inmate Welfare Trust
   15  Fund.—
   16         (1) The State-Operated Institutions Inmate Welfare Trust
   17  Fund is created within the department. The purpose of the trust
   18  fund is the benefit and welfare of inmates incarcerated in
   19  state-operated correctional facilities.
   20         (2) Moneys shall be deposited in and expenditures made from
   21  the trust fund as provided in s. 945.215.
   22         (3) Notwithstanding s. 216.301 and pursuant to s. 216.351,
   23  any balance in the trust fund at the end of a fiscal year must
   24  remain in the trust fund and be available for carrying out the
   25  purposes of the trust fund.
   26         (4) In accordance with s. 19(f)(2), Art. III of the State
   27  Constitution, the State-Operated Institutions Inmate Welfare
   28  Trust Fund shall, unless terminated sooner, be terminated on
   29  July 1, 2019. Before its scheduled termination, the trust fund
   30  shall be reviewed as provided in s. 215.3206(1) and (2).
   31         Section 2. This act shall take effect on the same date that
   32  SB 7020 or similar legislation takes effect, if such legislation
   33  is enacted in the same legislative session or an extension
   34  thereof and becomes law.
