Florida Senate - 2015 SB 598 By Senator Altman 16-00770-15 2015598__ 1 A bill to be entitled 2 An act relating to boating under the influence; 3 creating s. 322.266, F.S.; providing that a conviction 4 for boating under the influence be recorded in a 5 person’s driving record; providing that prior 6 convictions for boating under the influence are 7 considered prior convictions for driving under the 8 influence; amending s. 327.35, F.S.; providing that a 9 conviction for boating under the influence be reported 10 to the Department of Highway Safety and Motor 11 Vehicles; providing that prior convictions for driving 12 under the influence are considered prior convictions 13 for boating under the influence; providing an 14 effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Section 322.266, Florida Statutes, is created to 19 read: 20 322.266 Boating under the influence.— 21 (1) A conviction for boating under the influence (BUI) 22 reported to the department pursuant to s. 327.35 shall be 23 recorded on a person’s driving record in the same manner as a 24 conviction for driving under the influence under s. 316.193. 25 (2) A prior BUI conviction on a person’s driving record 26 shall be considered a prior conviction of s. 316.193 for 27 purposes of enforcing chapter 318 and this chapter. 28 Section 2. Present subsection (10) of section 327.35, 29 Florida Statutes, is redesignated as subsection (11), and a new 30 subsection (10) is added to that section, to read: 31 327.35 Boating under the influence; penalties; “designated 32 drivers.”— 33 (10)(a) A conviction under this section shall be reported 34 to the Department of Highway Safety and Motor Vehicles and shall 35 be recorded in the records of the department in the same manner 36 as a conviction for driving under the influence (DUI) under s. 37 316.193. 38 (b) A prior DUI conviction on a person’s driving record 39 shall be considered a prior conviction of this section for 40 purposes of enforcing this chapter. 41 Section 3. This act shall take effect July 1, 2015.
