    1                        A bill to be entitled                      
    2         An act relating to the land application of septage;
    3         amending s. 381.0065, F.S.; removing the future
    4         prohibition against the land application of septage
    5         from onsite treatment and disposal systems; requiring
    6         land application to be subject to certain
    7         requirements; defining the term “spring protection and
    8         management zone”; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (6) of section 381.0065, Florida
   13  Statutes, is amended to read:
   14         381.0065 Onsite sewage treatment and disposal systems;
   15  regulation.—
   16         (6) LAND APPLICATION OF SEPTAGE PROHIBITED.—Effective
   17  January 1, 2016, The land application of septage from onsite
   18  sewage treatment and disposal systems is subject to the
   19  following requirements in addition to any permit requirements:
   20  is prohibited.
   21         (a) If applied to an area delineated as a spring protection
   22  and management zone:
   23         1. Monthly inspections by the Department of Health;
   24         2. Metered receiving at treatment facilities;
   25         3. Testing with electronic pH meters rather than paper
   26  strips;
   27         4. Stabilized septage sampling;
   28         5. Annual tracking of nutrient loading based on septage
   29  sampling;
   30         6. Annual soil sampling of active application sites;
   31         7. Sites may not be sold, but may be transferred; and
   32         8. Additional sites may not be permitted.
   33         (b) If applied to an area that is not delineated as a
   34  spring protection and management zone:
   35         1. Quarterly inspections by the Department of Health;
   36         2. Metered receiving at treatment facilities;
   37         3. Testing with electronic pH meters rather than paper
   38  strips;
   39         4. Sites may be sold or transferred; and
   40         5. Additional sites may be permitted.

   42  As used in this subsection, the term “spring protection and
   43  management zone” means a springshed where the Floridan Aquifer
   44  is vulnerable to sources of contamination or reduced water
   45  levels, as determined by the Department of Environmental
   46  Protection in consultation with the appropriate water management
   47  districts.
   48         Section 2. This act shall take effect July 1, 2015.
