Senator Stargel moved the following:
1 Senate Amendment (with title amendment)

3 Delete lines 179 - 192
4 and insert:
5 Section 2. Subsection (5) is added to section 63.042,
6 Florida Statutes, to read:
7 63.042 Who may be adopted; who may adopt.—
8 (5) A person eligible under this section may not be
9 prohibited from adopting solely because that person desires to
10 educate the adopted child at home.
11 Section 3. Effective only if a statewide binding court
12 decision holds that subsection (3) of section 63.042, Florida
13 Statutes, is unconstitutional, subsection (3) of section 63.042,
14 Florida Statutes, is amended to read:
15 63.042 Who may be adopted; who may adopt.—
16 (3) No person eligible to adopt under this statute may
17 adopt if that person is a homosexual.
18 Section 4. The Department of Children and Families shall
19 notify the Division of Law Revision and Information if a
20 statewide binding court decision holds that subsection (3) of
21 section 63.042, Florida Statutes, is unconstitutional.
