Subsection (5) is added to section 63.042, 6 Florida Statutes, to read: 7 63.042 Who may be adopted; who may adopt.— 8 (5) A person eligible under this section may not be 9 prohibited from adopting solely because that person desires to 10 educate the adopted child at home. 11 Section 3. Effective only if a statewide binding court 12 decision holds that subsection (3) of section 63.042, Florida 13 Statutes, is unconstitutional, subsection (3) of section 63.042, 14 Florida Statutes, is amended to read: 15 63.042 Who may be adopted; who may adopt.— 16(3) No person eligible to adopt under this statute may17adopt if that person is a homosexual.18 Section 4.
