House Comm: RCS . 03/17/2015 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Governmental Oversight and Accountability (Hays) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete everything after the enacting clause 4 and insert: 5 Section 1. Present subsection (4) of section 97.0585, 6 Florida Statutes, is redesignated as subsection (3) of that 7 section, and present subsections (3) and (5) of that section are 8 transferred and renumbered as section 741.4651, Florida 9 Statutes, and amended to read: 10 741.4651 Public records exemption; victims of stalking or 11 aggravated stalking.— 12(3)The names, addresses, and telephone numbers of persons 13 who are victims of stalking or aggravated stalking are exempt 14 from s. 119.07(1) and s. 24(a), Art. I of the State Constitution 15 in the same manner that the names, addresses, and telephone 16 numbers of participants in the Address Confidentiality Program 17 for Victims of Domestic Violence which are held by the Attorney 18 General under s. 741.465 are exempt from disclosure, provided 19 that the victim files a sworn statement of stalking with the 20 Office of the Attorney General and otherwise complies with the 21 procedures in ss. 741.401-741.409. 22(5) Subsection (3) is subject to the Open Government Sunset23Review Act in accordance with s. 119.15 and shall stand repealed24on October 2, 2015, unless reviewed and saved from repeal25through reenactment by the Legislature.26 Section 2. This act shall take effect October 1, 2015. 27 28 ================= T I T L E A M E N D M E N T ================ 29 And the title is amended as follows: 30 Delete everything before the enacting clause 31 and insert: 32 A bill to be entitled 33 An act relating to a review under the Open Government 34 Sunset Review Act; transferring, renumbering, and 35 amending s. 97.0585(3) and (5), F.S., relating to an 36 exemption from public records requirements for certain 37 information of persons who are victims of stalking or 38 aggravated stalking; removing the scheduled repeal of 39 the exemption; providing an effective date.
