       Senator Garcia moved the following:
       
    1         Senate Amendment (with directory and title amendments)
    2  
    3         Between lines 155 and 156
    4  insert:
    5         (5) “Child or adolescent who has an emotional disturbance”
    6  means a person under 21 18 years of age who is diagnosed with a
    7  mental, emotional, or behavioral disorder of sufficient duration
    8  to meet one of the diagnostic categories specified in the most
    9  recent edition of the Diagnostic and Statistical Manual of the
   10  American Psychiatric Association, but who does not exhibit
   11  behaviors that substantially interfere with or limit his or her
   12  role or ability to function in the family, school, or community.
   13  The emotional disturbance must not be considered to be a
   14  temporary response to a stressful situation. The term does not
   15  include a child or adolescent who meets the criteria for
   16  involuntary placement under s. 394.467(1).
