Florida Senate - 2015 SB 756 By Senator Bullard 39-00868-15 2015756__ 1 A bill to be entitled 2 An act relating to trust funds; creating s. 1010.88, 3 F.S.; creating the Safe Schools Trust Fund within the 4 Department of Education; providing for sources of 5 funds and purposes; providing for annual carryforward 6 of trust fund balances; providing for future review 7 and termination or re-creation of the trust fund; 8 providing a contingent effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Section 1010.88, Florida Statutes, is created to 13 read: 14 1010.88 Safe Schools Trust Fund.— 15 (1) There is created the Safe Schools Trust Fund within the 16 department. Funds credited to the trust fund shall consist of 17 the funds deposited under s. 212.20(6)(d) and any other funds as 18 provided by law. 19 (2) The trust fund balance shall be allocated by the 20 department to school districts governed by this chapter to fund 21 expenses under s. 790.0535, s. 1006.025(4), and, to the extent 22 funds remain, additional projects and programs to improve the 23 safety of students while they are within school safety zones as 24 defined in s. 810.0975. 25 (3) Notwithstanding s. 216.301 and pursuant to s. 216.351, 26 any balance in the trust fund at the end of any fiscal year 27 shall remain in the trust fund at the end of the year and shall 28 be available for carrying out the purposes of the trust fund. 29 (4) In accordance with s. 19(f)(2), Art. III of the State 30 Constitution, the trust fund shall, unless terminated sooner, be 31 terminated on July 1, 2019. Before its scheduled termination, 32 the trust fund shall be reviewed as provided in s. 215.3206(1). 33 Section 2. This act shall take effect on the same date that 34 SB ____ or similar legislation takes effect, if such legislation 35 is enacted in the same legislative session or an extension 36 thereof and becomes law, and only if this act is enacted by a 37 three-fifths vote of the membership of each house of the 38 Legislature.
