to report annually the amount of materials they recycle to the
county annually beginning January 1, 2011, using the
department’s designated reporting format.
1. Using the information provided, the department shall

State Constitution. This subparagraph is subject to the Open

records requirements. This exemption is necessary to encourage
businesses to report information relating to their recycling
practices, so they can be recognized for their outstanding

could result in a chilling effect on business participation in
the program. Therefore, the Legislature declares that it is a
public necessity that the information reported by private
businesses which, if disclosed, would reveal a trade secret be
made exempt from public records requirements.
