Present paragraph (c) of subsection (4) of 6 section 395.402, Florida Statutes, is redesignated as paragraph 7 (d), and a new paragraph (c) is added to that subsection, to 8 read: 9 (c) In any trauma service area in which the department has 10 designated or provisionally approved a total of one Level I or 11 Level II trauma center and such trauma center ceases operation, 12 a need for an additional trauma center shall immediately be 13 established. A hospital within such trauma service area may 14 submit an application to operate as a Level I or Level II trauma 15 center at any time after the pre-existing trauma center ceases 16 operation without regard to whether the hospital filed a letter 17 of intent to operate as a trauma center. Because such an 18 application is not submitted within the review cycle established 19 in this part, the dates established in this part are not 20 applicable to an application submitted under this paragraph. For 21 an application submitted under this paragraph, the department 22 shall conduct a provisional review to determine whether the 23 application has the critical elements required for a trauma 24 center within 30 days after receiving the completed application 25 and conduct the in-depth evaluation of the application within 5 26 months after receiving the completed application. The department 27 shall conduct the onsite visits by a review team of out-of-state 28 experts within 11 months after receiving the completed 29 application and make a decision whether the hospital is selected 30 as a trauma center within 12 months after receiving the 31 completed application, unless the hospital seeks and obtains an 32 extension of its provisional status, in which case the 33 department may extend the provisional status of the application 34 for an additional 6 months. An application submitted under this 35 paragraph must comply with all other provisions of this part. 36 The department must comply with the dates and timeframes set 37 forth in this paragraph for administrative review and action on 38 applications submitted under this paragraph. 39 40 ================= T I T L E A M E N D M E N T ================ 41 And the title is amended as follows: 42 Delete line 3 43 and insert: 44 facilities and services; amending s. 395.402, F.S.; 45 providing a determination of need for an additional 46 trauma center where a previously existing trauma 47 center has ceased operation; authorizing a hospital to 48 submit an application to operate as a Level I or Level 49 II trauma center under certain circumstances; 50 providing timeframes for administrative review and 51 action on applications to operate as a trauma center 52 where a previously existing trauma center has ceased 53 operation; providing requirements for such 54 applications; amending s. 400.474, F.S.;
