       The Committee on Appropriations (Hays) recommended the
       following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 343 and 344
    4  insert:
    5         Section 3. Subsection (34) is added to section 334.044,
    6  Florida Statutes, to read:
    7         334.044 Department; powers and duties.—The department shall
    8  have the following general powers and duties:
    9         (34) At the department’s discretion, the ability:
   10         (a) To assume the responsibilities of the United States
   11  Department of Transportation with respect to highway projects
   12  within the state under the National Environmental Policy Act of
   13  1969, 42 U.S.C. ss. 4321 et seq., and with respect to the
   14  related responsibilities for environmental review, consultation,
   15  or other action required under any federal environmental law
   16  pertaining to review or approval of a highway project within the
   17  state;
   18         (b) To assume responsibilities under 23 U.S.C. s. 327 and
   19  enter into one or more agreements, including memoranda of
   20  understanding, with the United States Secretary of
   21  Transportation related to the federal surface transportation
   22  project delivery program for the delivery of highway projects,
   23  as provided in 23 U.S.C. s. 327; and
   24         (c) To adopt rules to implement this subsection and to
   25  adopt relevant federal environmental standards as the standards
   26  for this state for a program described in this subsection.

   28  Sovereign immunity from civil suit in federal court is waived
   29  consistent with 23 U.S.C. s. 327 and is limited to the
   30  compliance, discharge, or enforcement of a responsibility
   31  assumed by the department under this subsection.
