       The Committee on Environmental Preservation and Conservation
       (Dean) recommended the following:
       
    1         Senate Amendment to Amendment (612098)

    3         Delete lines 3244 - 3263
    4  and insert:
    5  (21)(a) Upon issuance of a construction permit to construct a
    6  new public water system drinking water treatment facility to
    7  provide potable water supply using a surface water of the state
    8  that, at the time of the permit application, is not being used
    9  as a potable water supply, and the classification of which does
   10  not include potable water supply as a designated use, the
   11  department shall add treated potable water supply as a
   12  designated use of the surface water segment in accordance with
   13  403.061(29)(b).
   14         (b) For existing public water system drinking water
   15  treatment facilities that use a surface water of the state as a
   16  treated potable water supply, which surface water classification
   17  does not include potable water as a designated use, the
   18  department shall add treated potable water supply as a
   19  designated use of the surface water segment in accordance with
   20  403.061(29)(b).
