Florida Senate - 2015 SB 920 By Senator Stargel 15-00739-15 2015920__ 1 A bill to be entitled 2 An act relating to abortion; creating a short title; 3 amending s. 390.0111, F.S.; requiring certain 4 physicians to have admitting privileges at a hospital 5 within a specified distance of the location where an 6 abortion is performed or induced; providing penalties; 7 providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. This act shall be known as the “Women’s Health 12 Protection Act.” 13 Section 2. Subsection (2) of section 390.0111, Florida 14 Statutes, is amended to read: 15 390.0111 Termination of pregnancies.— 16 (2) PERFORMANCE BY PHYSICIAN REQUIRED; ADMITTING PRIVILEGES 17 REQUIRED.— 18 (a) No termination of pregnancy shall be performed at any 19 time except by a physician as defined in s. 390.011. 20 (b) A physician performing or inducing an abortion must 21 have active admitting privileges at a hospital licensed in this 22 state on the date that the abortion is performed or induced. The 23 hospital must provide obstetrical or gynecological health care 24 services and be located 30 miles or less from the location at 25 which the abortion is performed or induced. A violation of this 26 paragraph by a physician constitutes grounds for disciplinary 27 action under s. 458.331 or s. 459.015. 28 Section 3. This act shall take effect July 1, 2015.
