Appropriations Subcommittee on Transportation, Tourism, and
Economic Development (Clemens) recommended the following:

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Subsection (1) of section 765.521, Florida
6 Statutes, is amended, present subsections (2) and (3) of that
7 section are redesignated as subsections (3) and (4),
8 respectively, and a new subsection (2) is added to that section,
9 to read:
10 765.521 Donations as part of driver license or
11 identification card process.—
12 (1) The agency and the department shall develop and
13 implement a program encouraging and allowing persons to make
14 anatomical gifts as a part of the process of issuing
15 identification cards and issuing and renewing driver licenses.
16 The department shall designate individuals employed in each
17 department office or facility as points of contact and require
18 them to ask each person transacting business with the department
19 if he or she would like to become an organ donor. The donor
20 registration card distributed by the department shall include
21 the information required by the uniform donor card under s.
22 765.514 and such additional information as determined necessary
23 by the department. The department shall also develop and
24 implement a program to identify donors which includes notations
25 on identification cards, driver licenses, and driver records or
26 such other methods as the department develops to clearly
27 indicate the individual’s intent to make an anatomical gift. A
28 notation on an individual’s driver license or identification
29 card that the individual intends to make an anatomical gift
30 satisfies all requirements for consent to organ or tissue
31 donation. The agency shall provide the necessary supplies and
32 forms from funds appropriated from general revenue or
33 contributions from interested voluntary, nonprofit
34 organizations. The department shall provide the necessary
35 recordkeeping system from funds appropriated from general
36 revenue. The department and the agency shall incur no liability
37 in connection with the performance of any acts authorized
38 herein.
39 (2) The department shall maintain an integrated link on its
40 website referring a visitor renewing a driver license or
41 conducting other business on the website to the organ donation
42 registry under s. 765.5155. The department shall establish a
43 procedure requiring department staff to confirm electronically
44 that the organ donor question required in subsection (1) has
45 been asked of each person entering the office or facility to
46 conduct business.
47 Section 2. The amendment made by this act in s. 765.521(2),
48 Florida Statutes, shall apply upon the development and
49 implementation of the vehicle registration system modernization
50 project by the Department of Highway Safety and Motor Vehicles.
51 Section 3. This act shall take effect July 1, 2015.

64 become an organ donor; requiring the department to
65 maintain an integrated website link to the organ
66 donation registry; requiring the department to
67 establish a procedure requiring department staff to
68 confirm electronically that the organ donor question
69 has been asked; providing for the future applicability
70 of an amendment upon the development and
71 implementation of a project by the department;
72 providing an effective date.
