SB 2506-A First Engrossed 20152506Ae1 1 A bill to be entitled 2 An act relating to the Florida Business Information 3 Portal; creating s. 20.166, F.S.; establishing the 4 Florida Business Information Portal within the 5 Department of Business and Professional Regulation; 6 requiring the department, in collaboration with 7 specified state agencies, to implement the portal by a 8 specified date; specifying the contents of the portal; 9 requiring designated state agencies to cooperate with 10 the department in the development, implementation, and 11 updates of the portal; requiring the department to 12 provide a report to the Governor and the Legislature 13 containing recommendations and estimated costs for the 14 inclusion of local government information in the 15 portal; repealing s. 215.1995, F.S., relating to the 16 One-Stop Business Registration Portal Clearing Trust 17 Fund; repealing s. 288.109, F.S., relating to the One 18 Stop Business Registration Portal; providing 19 procedures for the termination of the trust fund; 20 providing for construction of the act in pari materia 21 with laws enacted during the 2015 Regular Session of 22 the Legislature; providing for contingent retroactive 23 operation; providing effective dates. 24 25 Be It Enacted by the Legislature of the State of Florida: 26 27 Section 1. Section 20.166, Florida Statutes, is created to 28 read: 29 20.166 Florida Business Information Portal.— 30 (1) The Florida Business Information Portal is established 31 within the Department of Business and Professional Regulation. 32 (2) By June 30, 2017, the Department of Business and 33 Professional Regulation, in collaboration with the state 34 agencies identified in subsection (4), shall implement the 35 Florida Business Information Portal. The Florida Business 36 Information Portal shall provide the information needed to start 37 and operate a business in Florida, including information 38 regarding licenses, permits, or registrations that are issued by 39 the state agencies in subsection (4). 40 (3) The Florida Business Information Portal must provide at 41 least the following: 42 (a) A downloadable guide on how to start and operate a 43 business in Florida. 44 (b) A list of business types and a checklist for starting 45 each type of business. 46 (c) Links to guide users to the websites of appropriate 47 state licensing, permitting, and registration agencies. 48 (d) Information regarding business tax registration and 49 filing. 50 (e) Information regarding registering with the Department 51 of State. 52 (4) The state agencies that must cooperate with the 53 Department of Business and Professional Regulation in the 54 development, implementation, and ongoing content updates of the 55 Florida Business Information Portal include, but are not limited 56 to: 57 (a) The Agency for Health Care Administration. 58 (b) The Department of Agriculture and Consumer Services. 59 (c) The Department of Economic Opportunity. 60 (d) The Department of Environmental Protection. 61 (e) The Department of Financial Services, including the 62 Office of Financial Regulation and the Office of Insurance 63 Regulation. 64 (f) The Department of Health. 65 (g) The Department of Highway Safety and Motor Vehicles. 66 (h) The Department of the Lottery. 67 (i) The Department of Management Services. 68 (j) The Department of Revenue. 69 (k) The Department of State. 70 (l) The Fish and Wildlife Conservation Commission. 71 (5) By October 1, 2017, the Department of Business and 72 Professional Regulation shall submit to the Governor, the 73 President of the Senate, and the Speaker of the House of 74 Representatives a report containing recommendations and 75 estimated costs for the inclusion of local government 76 information in the Florida Business Information Portal. 77 Section 2. Section 215.1995, Florida Statutes, is repealed. 78 Section 3. Section 288.109, Florida Statutes, is repealed. 79 Section 4. The One-Stop Business Registration Portal 80 Clearing Trust Fund within the Department of Revenue, FLAIR 81 number 73-2-977, is terminated. The Chief Financial Officer 82 shall close out and remove the terminated trust fund from the 83 various state accounting systems using generally accepted 84 accounting principles concerning warrants outstanding, assets, 85 and liabilities. 86 Section 5. If any law amended by this act was also amended 87 by a law enacted during the 2015 Regular Session of the 88 Legislature, such laws shall be construed as if enacted during 89 the same session of the Legislature, and full effect shall be 90 given to each if possible. 91 Section 6. Except as otherwise expressly provided in this 92 act and except for this section, which shall take effect upon 93 this act becoming a law, this act shall take effect July 1, 94 2015, or, if this act fails to become a law until after that 95 date, it shall take effect upon becoming a law and operate 96 retroactively to July 1, 2015.
