Florida Senate - 2016 SB 1006 By Senator Hays 11-01413-16 20161006__ 1 A bill to be entitled 2 An act relating to warrantless arrests; amending s. 3 901.15, F.S.; permitting a law enforcement officer to 4 rely on information received from a first responder at 5 the scene of a traffic crash to arrest a person for 6 specified violations without a warrant; providing an 7 effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsection (5) of section 901.15, Florida 12 Statutes, is amended to read: 13 901.15 When arrest by officer without warrant is lawful.—A 14 law enforcement officer may arrest a person without a warrant 15 when: 16 (5) A violation of chapter 316 has been committed in the 17 presence of the officer. Such an arrest may be made immediately 18 or in fresh pursuit. Any law enforcement officer, upon receiving 19 information relayed to him or her from a fellow officer 20 stationed on the ground or in the air or from a first responder 21 at the scene of a traffic crash that a driver of a vehicle has 22 violated chapter 316, may arrest the driver for violation of 23 those laws when reasonable and proper identification of the 24 vehicle and the violation has been communicated to the arresting 25 officer. 26 Section 2. This act shall take effect July 1, 2016.
