       Senator Brandes moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 70 - 78
    4  and insert:
    5  only if the owner of the property is arrested for a criminal
    6  offense that forms the basis for determining that the property
    7  is a contraband article under s. 932.701, or one or more of the
    8  following circumstances apply:
    9         1. The owner of the property cannot be identified after a
   10  diligent search;
   11         2. The owner of the property is a fugitive from justice or
   12  is deceased; or
   13         3. An individual who does not own the property is arrested
   14  for a criminal offense that forms the basis for determining that
   15  the property is a contraband article under s. 932.701 and the
   16  owner of the property had actual
