Section 550.2416, Florida Statutes, is created 6 to read: 7 550.2416 Reporting of racing greyhound injuries.— 8 (1) This section may be cited as the “Victoria Q. Gaetz 9 Racing Greyhound Protection Act.” 10 (2) An injury to a racing greyhound which occurs while the 11 greyhound is located in this state must be reported on a form 12 adopted by the division within 7 days after the date on which 13 the injury occurs or is believed to have occurred. The presence 14 of cocaine found in a racing greyhound’s system is considered an 15 injury under this section. The division may adopt rules defining 16 the term “injury.” 17 (3) The form shall be completed and signed under oath or 18 affirmation by: 19 (a) The racetrack veterinarian or director of racing, if 20 the injury occurred at the racetrack facility; or 21 (b) The owner, trainer, or kennel operator who had 22 knowledge of the injury, if the injury occurred at a location 23 other than the racetrack facility, including during 24 transportation. 25 (4) The division shall fine, suspend, or revoke the license 26 of any individual who knowingly violates this section or who 27 intentionally causes an injury to a racing greyhound. 28 (5) The form must include the following: 29 (a) The greyhound’s registered name, right-ear and left-ear 30 tattoo numbers, and, if any, the microchip manufacturer and 31 number. 32 (b) The names, business addresses, and telephone numbers of 33 the greyhound’s owner, trainer, and kennel operator. 34 (c) The color, weight, and sex of the greyhound. 35 (d) The specific type and bodily location of the injury, 36 the cause of the injury, and the estimated recovery time from 37 the injury. 38 (e) If the injury occurred when the greyhound was racing: 39 1. The racetrack where the injury occurred; 40 2. The distance, grade, race, and post position of the 41 greyhound when the injury occurred; and 42 3. The weather conditions, time, and track conditions when 43 the injury occurred. 44 (f) If the injury occurred when the greyhound was not 45 racing: 46 1. The location where the injury occurred; and 47 2. The circumstances surrounding the injury. 48 (g) Other information that the division determines is 49 necessary to identify injuries to racing greyhounds in this 50 state. 51 (6) An injury form created pursuant to this section must be 52 maintained as a public record by the division for at least 7 53 years after the date it was received. 54 (7) A licensee of the department who knowingly makes a 55 false statement concerning an injury or fails to report an 56 injury is subject to disciplinary action under this chapter, and 57 chapters 455 and 474. 58 (8) This section does not apply to injuries to a service 59 animal, a personal pet, or a greyhound that has been adopted as 60 a pet. 61 (9) The division shall adopt rules to implement this 62 section. 63 64 ================= T I T L E A M E N D M E N T ================ 65 And the title is amended as follows: 66 Between lines 143 and 144 67 insert: 68 creating s. 550.2416, F.S.; providing a short title; 69 requiring injuries to racing greyhounds to be reported 70 within a certain timeframe on a form adopted by the 71 Division of Pari-mutuel Wagering of the department; 72 requiring such form to be completed and signed under 73 oath or affirmation by certain individuals; providing 74 penalties; specifying information that must be 75 included in the form; requiring the division to 76 maintain the forms as public records for a specified 77 time; specifying disciplinary action that may be taken 78 against a licensee of the department who fails to 79 report an injury or who makes false statements on an 80 injury form; exempting injuries to certain animals 81 from reporting requirements; requiring the division to 82 adopt rules;
