       Senator Abruzzo moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1130 and 1131
    4  insert:
    5         Section 40. Subsection (2) of section 718.103, Florida
    6  Statutes, is amended to read:
    7         718.103 Definitions.—As used in this chapter, the term:
    8         (2) “Association” means, in addition to any entity
    9  responsible for the operation of common elements owned in
   10  undivided shares by unit owners, any entity which operates or
   11  maintains other real property in which unit owners have use
   12  rights, where membership in the entity is composed exclusively
   13  of unit owners or their elected or appointed representatives and
   14  is a required condition of unit ownership. The term includes an
   15  umbrella association or organization. For purposes of this
   16  subsection, the term “umbrella association or organization”
   17  means an entity and its subordinate committees responsible for
   18  the operation of common elements owned in undivided shares by
   19  unit owners, any entity and its subcommittees that operate or
   20  maintain other real property in which unit owners have use
   21  rights, where membership in the entity or subcommittees is
   22  composed exclusively of unit owners or their elected or
   23  appointed representatives.

   28  and insert:
   29         adopt rules; amending s. 718.103, F.S.; revising a
   30         definition; providing an effective date.
