Senator Margolis moved the following:

4 insert:
5 Section 40. Section 550.6346, Florida Statutes, is created
6 to read:
7 550.6346 Advance deposit wagering.—
8 (1) As used in this section, the term:
9 (a) “Advance deposit wagering” means a form of pari-mutuel
10 wagering in which an individual deposits money into an account
11 with a person authorized by the division to conduct advance
12 deposit wagering and such individual uses the account funds to
13 pay for pari-mutuel wagers made in person, by telephone, or
14 through communication by other electronic means.
15 (b) “Permitholder” means a person that is issued a permit
16 under this chapter.
17 (2) The division may authorize advance deposit wagering
18 conducted by:
19 (a) A permitholder; or
20 (b) An operator of an advance deposit wagering system
21 accepting wagers pursuant to an agreement with a permitholder if
22 the agreement is approved by the division.
23 (3) A person authorized to conduct advance deposit wagering
24 under subsection (2) may accept advance deposit wagering for
25 races conducted:
26 (a) In this state under a permit issued under this chapter;
27 or
28 (b) In another state on a schedule approved by the
29 permitholder.
30 (4) A person authorized to conduct advance deposit wagering
31 under subsection (2) may not:
32 (a) Accept an account wager in an amount in excess of the
33 funds on deposit in the advance deposit wagering account of the
34 individual placing the wager; or
35 (b) Allow an individual younger than 21 years of age to
36 open, own, or have access to an advance deposit wagering
37 account.
38 (5) A person authorized to conduct advance deposit wagering
39 under subsection (2) shall:
40 (a) Include a statement in all forms of advertising for
41 advance deposit wagering that an individual younger than 21
42 years of age may not open, own, or have access to an advance
43 deposit wagering account; and
44 (b) Verify the identification, residence, and age of the
45 advance deposit wagering account holder by using methods and
46 technologies approved by the division.
47 (6) A resident or any other individual located within this
48 state may not place a wager through a system of advance deposit
49 wagering except with a person authorized to conduct advance
50 deposit wagering under subsection (2). Only persons authorized
51 to conduct advance deposit wagering under subsection (2) may
52 accept wagers from residents or other individuals located within
53 this state.
54 (7) The division shall adopt rules to administer this
55 section.

60 and insert:
61 adopt rules; creating s. 550.6346, F.S.; defining
62 terms; providing that the Division of Pari-mutuel
63 Wagering of the Department of Business and
64 Professional Regulation may authorize advance deposit
65 wagering conducted by certain permitholders or certain
66 operators contracting with a permitholder; specifying
67 requirements, prohibitions, and authorizations for a
68 person authorized to conduct advance deposit wagering;
69 prohibiting a resident or other individual from
70 placing a wager through an advance deposit wagering
71 system under specified circumstances; providing an
72 effective date.
