    2         An act relating to cyber harassment; amending s.
    3         784.049, F.S.; revising the definition of the term
    4         “sexually explicit image”; providing an effective
    5         date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Paragraph (d) of subsection (2) of section
   10  784.049, Florida Statutes, is amended to read:
   11         784.049 Sexual cyberharassment.—
   12         (2) As used in this section, the term:
   13         (d) “Sexually explicit image” means any image depicting
   14  nudity, as defined in s. 847.001, or depicting a person engaging
   15  in sexual conduct, as defined in s. 847.001, that from the facts
   16  and circumstances was intended by that person to be and remain
   17  confidential.
   18         Section 2. This act shall take effect July 1, 2016.
