    1                        A bill to be entitled                      
    2         An act relating to prescribing medicinal drugs and
    3         controlled substances; amending s. 456.42, F.S.;
    4         authorizing certain health care practitioners to
    5         include medical conditions on prescriptions if a
    6         certain waiver is obtained, and to direct pharmacists
    7         and dispensing practitioners to include the conditions
    8         on the labels of dispensing containers; providing an
    9         effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (3) is added to section 456.42,
   14  Florida Statutes, to read:
   15         456.42 Written prescriptions for medicinal drugs.—
   16         (3) A health care practitioner licensed by law to prescribe
   17  medicinal drugs, or controlled substances listed in chapter 893,
   18  may, upon the request of the patient or his or her legal
   19  representative, include on a written or electronic prescription
   20  the medical condition for which the drug or controlled substance
   21  is being prescribed, and direct the pharmacist or dispensing
   22  practitioner to include the condition on the label of the
   23  dispensing container, if the health care practitioner
   24  prescribing the medicinal drug or controlled substance has first
   25  obtained from the patient or his or her legal representative a
   26  written or verbal waiver, documented in the patient’s medical
   27  records, of the patient’s privacy rights under the Health
   28  Insurance Portability and Accountability Act, or successor acts,
   29  for the health care practitioner to include the patient’s
   30  medical condition on the prescription and the dispensing
   31  container.
   32         Section 2. This act shall take effect July 1, 2016.
