Florida Senate - 2016 SB 154 By Senator Thompson 12-00216-16 2016154__ 1 A bill to be entitled 2 An act relating to prohibited displays of the 3 Confederate flag or emblem; creating s. 256.101, F.S.; 4 prohibiting the display of flags and emblems 5 associated with the Confederate States of America on 6 any publicly owned or leased property; providing for 7 injunctive relief and attorney fees; providing an 8 effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Section 256.101, Florida Statutes, is created to 13 read: 14 256.101 Display of Confederate flag or emblem on publicly 15 owned or leased property prohibited.— 16 (1) The display of the flag or emblem of the Confederate 17 States of America or any flag or emblem used by the Confederate 18 States of America or its military or naval forces at any time 19 within the years 1860 to 1865 on any building, structure, real 20 property, or personal property owned or leased by the state, a 21 county, a municipality, or other governmental unit of this state 22 is prohibited. 23 (2) An interested party may bring a civil action for 24 injunctive relief to enjoin the display of a flag or emblem 25 prohibited by this section. The prevailing party in such action 26 is entitled to recover reasonable attorney fees. 27 Section 2. This act shall take effect upon becoming a law.
