Florida Senate - 2016 SB 1688 By Senator Sachs 34-01604-16 20161688__ 1 A bill to be entitled 2 An act relating to the Florida Veterans Foundation; 3 amending ss. 320.02, 322.08, and 328.72, F.S.; 4 providing for voluntary contributions of a minimum 5 specified amount per applicant for certain motor 6 vehicle registrations, driver licenses or 7 identification cards, and boat registrations to the 8 Florida Veterans Foundation; conforming a cross 9 reference; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (v) is added to subsection (15) of 14 section 320.02, Florida Statutes, to read: 15 320.02 Registration required; application for registration; 16 forms.— 17 (15) 18 (v) The application form for motor vehicle registration and 19 renewal of registration must include language permitting a 20 voluntary contribution of $1 or more per applicant, which shall 21 be distributed by the department to the Florida Veterans 22 Foundation. 23 24 For the purpose of applying the service charge provided in s. 25 215.20, contributions received under this subsection are not 26 income of a revenue nature. 27 Section 2. Subsection (8) of section 322.08, Florida 28 Statutes, is amended to read: 29 322.08 Application for license; requirements for license 30 and identification card forms.— 31 (8) The application form for an original, renewal, or 32 replacement driver license or identification card must include 33 language permitting the following: 34 (a) A voluntary contribution of $1 per applicant, which 35 contribution shall be deposited into the Health Care Trust Fund 36 for organ and tissue donor education and for maintaining the 37 organ and tissue donor registry. 38 (b) A voluntary contribution of $1 per applicant, which 39 shall be distributed to the Florida Council of the Blind. 40 (c) A voluntary contribution of $2 per applicant, which 41 shall be distributed to the Hearing Research Institute, 42 Incorporated. 43 (d) A voluntary contribution of $1 per applicant, which 44 shall be distributed to the Juvenile Diabetes Foundation 45 International. 46 (e) A voluntary contribution of $1 per applicant, which 47 shall be distributed to the Children’s Hearing Help Fund. 48 (f) A voluntary contribution of $1 per applicant, which 49 shall be distributed to Family First, a nonprofit organization. 50 (g) A voluntary contribution of $1 per applicant to Stop 51 Heart Disease, which shall be distributed to the Florida Heart 52 Research Institute, a nonprofit organization. 53 (h) A voluntary contribution of $1 per applicant to Senior 54 Vision Services, which shall be distributed to the Florida 55 Association of Agencies Serving the Blind, Inc., a not-for 56 profit organization. 57 (i) A voluntary contribution of $1 per applicant for 58 services for persons with developmental disabilities, which 59 shall be distributed to The Arc of Florida. 60 (j) A voluntary contribution of $1 to the Ronald McDonald 61 House, which shall be distributed each month to Ronald McDonald 62 House Charities of Tampa Bay, Inc. 63 (k) Notwithstanding s. 322.081, a voluntary contribution of 64 $1 per applicant, which shall be distributed to the League 65 Against Cancer/La Liga Contra el Cancer, a not-for-profit 66 organization. 67 (l) A voluntary contribution of $1 per applicant to Prevent 68 Child Sexual Abuse, which shall be distributed to Lauren’s Kids, 69 Inc., a nonprofit organization. 70 (m) A voluntary contribution of $1 per applicant, which 71 shall be distributed to Prevent Blindness Florida, a not-for 72 profit organization, to prevent blindness and preserve the sight 73 of the residents of this state. 74 (n) Notwithstanding s. 322.081, a voluntary contribution of 75 $1 per applicant to the state homes for veterans, to be 76 distributed on a quarterly basis by the department to the State 77 Homes for Veterans Trust Fund, which is administered by the 78 Department of Veterans’ Affairs. 79 (o) A voluntary contribution of $1 per applicant to the 80 Disabled American Veterans, Department of Florida, which shall 81 be distributed quarterly to Disabled American Veterans, 82 Department of Florida, a nonprofit organization. 83 (p) A voluntary contribution of $1 per applicant for Autism 84 Services and Supports, which shall be distributed to Achievement 85 and Rehabilitation Centers, Inc., Autism Services Fund. 86 (q) A voluntary contribution of $1 per applicant to Support 87 Our Troops, which shall be distributed to Support Our Troops, 88 Inc., a Florida not-for-profit organization. 89 (r) A voluntary contribution of $1 or more per applicant, 90 which shall be distributed to the Auto Club Group Traffic Safety 91 Foundation, Inc., a not-for-profit organization. 92 (s) Notwithstanding s. 322.081, a voluntary contribution of 93 $1 per applicant to aid the homeless. Contributions made 94 pursuant to this paragraph shall be deposited into the Grants 95 and Donations Trust Fund of the Department of Children and 96 Families and used by the State Office on Homelessness to 97 supplement grants made under s. 420.622(4) and (5), provide 98 information to the public about homelessness in the state, and 99 provide literature for homeless persons seeking assistance. 100 (t) A voluntary contribution of $1 or more per applicant to 101 End Breast Cancer, which shall be distributed to the Florida 102 Breast Cancer Foundation. 103 (u) A voluntary contribution of $1 or more per applicant, 104 which shall be distributed to the Florida Veterans Foundation. 105 106 A statement providing an explanation of the purpose of the trust 107 funds shall also be included. For the purpose of applying the 108 service charge provided under s. 215.20, contributions received 109 under paragraphs (b)-(u)(b)-(t)are not income of a revenue 110 nature. 111 Section 3. Subsection (11) of section 328.72, Florida 112 Statutes, is amended to read: 113 328.72 Classification; registration; fees and charges; 114 surcharge; disposition of fees; fines; marine turtle stickers.— 115 (11) VOLUNTARY CONTRIBUTIONS.— 116 (a) The application form for boat registration shall 117 include a provision to allow each applicant to indicate a desire 118 to pay an additional voluntary contribution to the Save the 119 Manatee Trust Fund to be used for the purposes specified in s. 120 379.2431(4). This contribution shall be in addition to all other 121 fees and charges. The amount of the request for a voluntary 122 contribution solicited shall be $2 or $5 per registrant. A 123 registrant who provides a voluntary contribution of $5 or more 124 shall be given a sticker or emblem by the tax collector to 125 display, which signifies support for the Save the Manatee Trust 126 Fund. All voluntary contributions shall be deposited in the Save 127 the Manatee Trust Fund and shall be used for the purposes 128 specified in s. 379.2431(4). 129 (b) The form shall also include language permitting a 130 voluntary contribution of $5 per applicant, which contribution 131 shall be transferred into the Election Campaign Financing Trust 132 Fund. A statement providing an explanation of the purpose of the 133 trust fund shall also be included. 134 (c) The form shall also include language permitting a 135 voluntary contribution of $1 or more per applicant, which 136 contribution shall be transferred to the Florida Veterans 137 Foundation. 138 Section 4. This act shall take effect July 1, 2016.
