Florida Senate - 2016 SB 1702 By Senator Sachs 34-01649-16 20161702__ 1 A bill to be entitled 2 An act relating to sexual offenses involving 3 postsecondary students; creating s. 943.0431, F.S.; 4 requiring that law enforcement agencies report certain 5 sexual offenses involving postsecondary students to a 6 designated official at the postsecondary institution; 7 providing a definition; creating ss. 1005.11 and 8 1006.6951, F.S.; requiring specified postsecondary 9 institutions to require that information on sexual 10 assault be included in course syllabi; providing an 11 effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Section 943.0431, Florida Statutes, is created 16 to read: 17 943.0431 Reporting sexual offenses involving postsecondary 18 students.—A law enforcement agency investigating an alleged 19 sexual offense must, if both the alleged perpetrator and the 20 victim of the offense are students at the same Florida College 21 System institution, state university, or nonpublic college, 22 university, or school, as defined in s. 1000.21 or s. 1005.02, 23 at the time of the offense, report the offense to the Title IX 24 coordinator of that institution within 10 days after the first 25 report of the incident or within 10 days after learning of the 26 student status of the alleged perpetrator and victim, whichever 27 is later. For purposes of this section, the term “sexual 28 offense” means a sexual offense, whether forcible or 29 nonforcible, as such offenses are classified under the uniform 30 crime reporting system of the Federal Bureau of Investigation. 31 Section 2. Section 1005.11, Florida Statutes, is created to 32 read: 33 1005.11 Information on sexual assault.—Each nonpublic 34 college, university, and school shall require all course syllabi 35 to include information on how to report sexual assault and how 36 to obtain resources available to a victim of sexual assault. 37 Section 3. Section 1006.6951, Florida Statutes, is created 38 to read: 39 1006.6951 Information on sexual assault.—Each Florida 40 College System institution as defined in s. 1000.21, state 41 university as defined in s. 1000.21, and career center as 42 provided in s. 1001.44 shall require all course syllabi to 43 include information on how to report sexual assault and how to 44 obtain resources available to a victim of sexual assault. 45 Section 4. This act shall take effect January 1, 2017.
