Florida Senate - 2016 CS for CS for CS for SB 172 By the Committees on Appropriations; Finance and Tax; and Community Affairs; and Senators Brandes and Hutson 576-04821-16 2016172c3 1 A bill to be entitled 2 An act relating to a special election; providing for a 3 special election to be held August 30, 2016, pursuant 4 to Section 5 of Article XI of the State Constitution, 5 for the approval or rejection by the electors of this 6 state of amendments to the State Constitution, 7 proposed by joint resolution, relating to an exemption 8 from the tangible personal property tax for solar or 9 renewable energy source devices, a limitation on the 10 assessed value of real property used for 11 nonresidential purposes for the installation of such 12 devices, and an effective date if such amendments are 13 adopted; providing for publication of notice and for 14 procedures; providing a contingent effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Pursuant to Section 5 of Article XI of the State 19 Constitution, there shall be a special election on August 30, 20 2016, to be held concurrently with other statewide elections 21 held on that date, if any, at which there shall be submitted to 22 the electors of this state for approval or rejection the 23 amendments to the State Constitution proposed in Senate Joint 24 Resolution 170, 2016 Regular Session, or a similar joint 25 resolution having substantially the same specific intent and 26 purpose. 27 Section 2. Publication of notice shall be in accordance 28 with Section 5 of Article XI of the State Constitution. The 29 special election shall be held as other special elections are 30 held. 31 Section 3. This act shall take effect upon becoming a law 32 if enacted by a vote of at least three-fourths of the membership 33 of each house of the Legislature and if Senate Joint Resolution 34 170, 2016 Regular Session, or a similar joint resolution having 35 substantially the same specific intent and purpose, is adopted 36 by both houses of the Legislature.
