Florida Senate - 2016 CS for SB 200 By the Committee on Criminal Justice; and Senator Hukill 591-02910-16 2016200c1 1 A bill to be entitled 2 An act relating to animals confined in unattended 3 motor vehicles; providing a short title; creating s. 4 828.075, F.S.; prohibiting a person from confining an 5 animal in an unattended motor vehicle under certain 6 circumstances; providing a criminal penalty; providing 7 an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. This act may be cited as the “Protecting Animal 12 Welfare and Safety Act” or “P.A.W.S. Act.” 13 Section 2. Section 828.075, Florida Statutes, is created to 14 read: 15 828.075 Animals in unattended motor vehicles.—A person who 16 intentionally, knowingly, or recklessly confines an animal in an 17 unattended motor vehicle under conditions that endanger the 18 health or well-being of the animal due to heat, cold, lack of 19 adequate ventilation, lack of food or water, or other 20 circumstances that could reasonably be expected to cause 21 suffering, disability, or death of the animal commits a 22 misdemeanor of the first degree, punishable as provided in s. 23 775.082 or s. 775.083. 24 Section 3. This act shall take effect July 1, 2016. 25
