       The Committee on Criminal Justice (Brandes) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 64 - 67
    4  and insert:
    5  misdemeanor of the first degree, punishable as provided in s.
    6  775.082 or s. 775.083. A second or subsequent violation of this
    7  paragraph constitutes a felony of the third degree, punishable
    8  as provided in s. 775.082, s. 775.083, or s. 775.084.
