       Senator Clemens moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 143 - 170
    4  and insert:
    5  not include the: possession, use, or administration by smoking.
    6  The term also does not include the
    7         1. Transfer of low-THC cannabis or medical cannabis to a
    8  person other than the qualified patient for whom it was ordered
    9  or the qualified patient’s legal representative on behalf of the
   10  qualified patient.
   11         2. Use or administration of low-THC cannabis or medical
   12  cannabis:
   13         a. On any form of public transportation.
   14         b. In any public place.
   15         c. In a qualified patient’s place of employment, if
   16  restricted by his or her employer.
   17         d. In a state correctional institution as defined in s.
   18  944.02 or a correctional institution as defined in s. 944.241.
   19         e. On the grounds of a preschool, primary school, or
   20  secondary school.
   21         f. On a school bus or in a vehicle, aircraft, or motorboat.
   22         (h)(d) “Qualified patient” means a resident of this state
   23  who has been added to the compassionate use registry by a
   24  physician licensed under chapter 458 or chapter 459 to receive
   25  low-THC cannabis or medical cannabis from a dispensing
   26  organization.
   27         (e) “Smoking” means burning or igniting a substance and
   28  inhaling the smoke. Smoking does not include the use of a
   29  vaporizer.
